above the Number of Twenty Jurors, or on his or her Arraignment,
wilfuly standing Mute, or refusing to plead, shall suffer Death as a
Felon, without the Benefit of Clergy.
XVII. And be it further Enacted, That in case any Warehouse
to be erected in virtue of this Act, should happen to be burnt, and
the Tobacco therein or any Part thereof be thereby destroyed, the
Public of this Province shall not in any wise be burthened or charged
therewith; but the same shall be the Loss of the Proprietors thereof;
any Law to the contrary notwithstanding.

XVIII. And be it further Enacted, That this Act, nor any Thing
herein contained, shall compel or be construed to compel the Pro-
prietors of any Tobacco, to carry, to lodge, or store in any of the
said Warehouses to be erected by virtue of this Act, their said
Tobacco; but every Person whatsoever, may freely Ship the same
off from the Inspecting Houses, as if this Act had not been made.
